The Supreme Court ruled in favor of Ademola Adeleke as Osun State Governor after setting aside the appeal by Adegboyega Oyetola of the All Progressives Congress (APC) on Tuesday.
Oyetola had challenged Adeleke’s election under the Peoples Democratic Party (PDP) but the apex court upheld the Appeal Court’s judgment, citing the appellant’s failure to provide enough evidence to prove over-voting allegations in the July 16, 2022 governorship poll.
The entire five-member panel adopted the judgment, declaring the appeal lacked merit. The Independent National Electoral Commission (INEC) had declared Adeleke the winner of the poll with 403,371 votes, unseating Oyetola, the incumbent with 375,027 votes.
Oyetola and his party had contested the polls, leading to Adeleke’s victory being overturned by Justice Tertse Kume, who declared Oyetola the winner on January 27, 2023.
Adeleke and the PDP challenged the Tribunal judgment, which the Court of Appeal nullified and returned Adeleke as the winner on March 24. The Supreme Court upheld Adeleke’s victory after Oyetola and the PDP contested the Appeal Court’s verdict.
